The Boobapalooza and Yes They're Fake! websites (www.boobapalooza.com, yestheyrefake.net) are owned and operated by Enhancement Media of Las Vegas, Nevada USA. Whenever the names, "Yes They're Fake", "Yes They're Fake! Cosmetic Surgery & Product Report", "YTF", "Boobapalooza" or the world wide web addresses, www.yestheyrefake.net and www.boobapalooza.com, are utilized within this document, in its entirety, Enhancement Media is the sole owner and administrator of  said names, URLs, content, work products, text files, photos, dialogues, etc.. Said names referred to in any and all sections of the Website Terms & Conditions of Use are therefore considered the sole property of Enhancement Media. All rules, Terms of Use and Disclaimers apply to any and all content of the site including and not limited to all web pages, message boards, discussion forums, bulletin boards, CHAT rooms, message centers, journals, interviews, URLs, content, work products, text files, photos, dialogues and guest books.  All Enhancement Media message boards and shat rooms are provided free of charge to you by Enhancement Media under these Terms & Conditions of Use.  This collection of information and its adjoining works are gove rned under the laws of the United States of America. All national an international copyright © and trademark ® ™laws apply. 

Section 1 - General

1. Abusive derision, ridicule and/or public humiliation or slandering will NOT be tolerated and Enhancement Media holds the right to ban, expose, trace, report, press charges and give details of the offender in question, to the offender's local governing authority, regarding violation of these terms & conditions of use.

2. Rude behavior such as racist remarks, offensive language, blasphemy, remarks regarding sexual preference and gender-related harassment will NOT be tolerated and Enhancement Media holds the right to ban, expose, trace, report, press charges and give details of the offender in question, to the offender's local governing authority, regarding violation of these terms & conditions of use.

3. Stalking and stalking-like behavior is prohibited and will be reported to the offender's local governing authority.

4. Blatant breach of the personal privacy of others will be grounds for banning from Enhancement Media websites. 

5. Soliciting members to other websites, slandering of Enhancement Media Websites through a visitor's private email address is grounds for termination of use and will NOT be tolerated. Enhancement Media holds the right to ban, expose, trace, report, press charges and give details of the offender in question, to the offender's local governing authority, regarding violation of these terms & conditions of use.

6. Obscene or vulgar postings of photos, graphics, clippings, text files, links, CGI, etc., including pornographic material, or links to such, is prohibited and grounds for termination of use will be carried out. Medical photos of particular body parts are allowed, but only if related to medical procedures being discussed, requested or highlighted. 

Section 2 -  Privacy Policy

We at Enhancement Media, its websites and its sub-sites, respect the privacy of our visitors, guests and sponsors. By using this website you agree that Enhancement Media may disclose information Enhancement Media has collected from you and/or content you have made available on our site if Enhancement media deems the law requires it and to protect the rights or property of Enhancement Media, its visitors, guests and sponsors. 

Do realize that the Internet is a public place and even our password protected areas may be infiltrated by persons who are not authorized to do so. Please remember when posting any personal information about yourself, such as your phone numbers, email address, location addresses, specific descriptions as unfortunately there are persons who do stalk websites to gather such information from its patrons. If you come across any type of stalking or stalking-type behavior please let us and know and Enhancement Media will help you in reporting this information to your local and Internet governing agencies.

If Enhancement media deems it necessary to expose, either privately or publicly, persons who are being untruthful, deceptive or deceitful and believe that our exposing such regarding their information Enhancement Media retains the right to do so. 

Section 3 - Conduct & Behavior

Enhancement Media actively reviews, researches and verifies information transmitted, posted, conveyed, divulged, disclosed, or shared by visitors, patrons, guests and sponsors of any Enhancement Media web site and reserves the right although has no obligation or duty to monitor the information transmitted, posted, conveyed, divulged, disclosed, or shared by visitors, patrons, guests and sponsors on any message board, bulletin board, discussion forum, noteboard or chat room. Enhancement Media does retain the right to remove any information, no matter the reason, at our sole discretion at any given time. Enhancement Media holds no obligation to convey to you its intentions regarding a said removal of any material or information transmitted, posted, conveyed, divulged, disclosed, or shared by visitors, patrons, guests and sponsors of any Enhancement Media web site 

Section 4 - Visitor Responsibility & Liability

The content, be it text files, photos, information, CGI, messages, posts, chat dialogue, etc is the sole responsibility of the visitor, patron or guest and that person's responsibility only.  You are held accountable and liable for anything that you, the visitor, patron or guest transmits, posts, conveys, divulges, discloses, or shares on any Enhancement Media Website or its visitors, patrons or guests. Enhancement Media holds the right to ban, expose, trace, report, press charges and give details of the offender in question, to the offender's local governing authority, regarding violation of these terms & conditions of use.

Section 5 - Work Product Rights

Any information, work product, dialogue, photos, interviews, quotes, messages, stories, clippings, videos, etc. submitted to Enhancement Media its owners, subsites, subsidiaries, affiliates, members, business partners, employees, researchers, moderators and volunteers will be returned at your request. Enhancement Media will not retain your information, work product, dialogue, photos, interviews, quotes, messages, stories, clippings, videos, etc. Enhancement Media believes this to be the morally correct thing to do and will never exploit any of its visitors, patrons, guests or sponsors.  Enhancement Media considers any visitor, patron, guest or sponsor to be a part of our "family" and Enhancement Media believes this is not the way to treat family. If any visitor, patron, guest or sponsor wishes to have their information, work product, dialogue, photos, interviews, quotes, messages, stories, clippings, videos, etc. removed from its websites, we will do so immediately.

Section 6 - Work Product Rights of Enhancement Media

You agree that any and all information, work product, dialogue, photos, interviews, quotes, messages, stories, clippings, videos, etc.  provided by ANY AND ALL Enhancement Media websites, its sponsors, researchers, contributors, volunteers, visitors, patrons, guests and/or others is protected by national and international copyrights, trademarks, service marks, patents, or other proprietary rights and laws. Unless otherwise indicated, you may display, reformat and print no more than three (3) copies of any content obtained through our site for your individual, noncommercial use only. One copy for your own use, one copy for a back up and one to distribute to one (1) other person. 

You further agree not to otherwise copy, change or alter, upload, transmit, sell or distribute any information, work product, dialogue, photos, interviews, quotes, messages, stories, clippings, videos, etc., either digitally or through print, available through this site, including any code and/or software.

Section 6 - Visitor Compliance

By continuing to use any Enhancement Media website, you agree:

1. to follow all local, state, government, national and international laws and regulations pertaining to you.

Visitor Compliance, Part II

By continuing to use any Enhancement Media website, you further agree not to:

1. transmit through any Enhancement Media Website any abusive, destructive, harmful, harassing, obscene, offensive, slanderous, threatening, unlawful, or otherwise objectionable content.

2. copy, broadcast, distribute, redistribute, take advantage of or otherwise use any content provided by Enhancement media, its visitors, patrons, guests and sponsors, in a manner that is any abusive, destructive, harmful, harassing, obscene, offensive, slanderous, threatening, unlawful, or otherwise objectionable.

3. interfere, disrupt, obstruct, impede, cause harm to, infiltrate, hack into, mar, upset, dislocate, destroy, etc. any of Enhancement Media or its websites' services, computer systems, remote hardware, servers, networks, complexes, structures, or violate the regulations or policies of such networks.

4. transmit any content containing viruses, Trojan horses, worms, time bombs, cancelbots, bugs, extraction programs, data disruptors, data repeaters, or any other harmful programs or infiltration tactics. 

5. attempt to gain unauthorized access to Enhancement Media's websites, computer systems, remote hardware, servers, networks, complexes, structures, administration areas, or private files.

6. participate in CGI bin milling or trawling, private archive milling or trawling - trawling of any .htm, .html document, .gif, .jpg, .jpeg, .bmp, or other format that is strictly not accessible via the links through the website in question. This includes all servers, storage units or complexes and websites of Enhancement Media.

7. engage in any systematic extraction of data or data fields, including without limitation, e-mail addresses, user systems, operating systems, resolutions, cookies, internet service providers, locations, time zones, etc. 

8. collect information about others without their consent. FOR ANY USE.

9. provide false information about your identity, impersonate any person or gender to gain access to, deceive others or for any other reason without limitation.

10. transmit junk mail, "spam", chain letters, mailing lists, "tip of the day" "joke of the day" or other unsolicited bulk email or duplicative messages on any message board, personal email or otherwise, for any reason at any time.

11. copy any video clips or sounds clips on our website for any use other than personal.

12. promote or participate in any harassment, slander or disruption of any message board, chat room or public discussion forum, , for any reason at any time.

13. promote or participate in any libelous behavior while engaged in any interaction on any Enhancement Media website or its functions, for any reason at any time.

14. drive any visitor, patron, guest or sponsor away from any Enhancement Media website or function, for any reason, at any time.

15. dissuade any person from visiting or attending any Enhancement media Website or function, for any reason at any time.
    

Section 7 - Termination of Use 

If at any time, Enhancement Media deems that any of its visitors, patrons, guests or sponsors have violated these Terms of Use in any way, at their sole discretion, Enhancement Media may target, ban, report, and take action on any person at any time without prior notice to you. Enhancement Media retains and holds the right to do so at any time and holds no obligation to its visitors, patrons or guests and will at its own discretion make this decision and carry it out in the fashion it deems as necessary and expedient.

If at any time a visitor, patron or guest is banned or otherwise no longer permitted access to its information, message boards, bulletin boards, chat rooms, public noteboards, etc. and the said banned visitor, patron or guest attempts to gain access - Enhancement Media holds the right to take action upon said offender.

Enhancement Media reserves the right, at its sole discretion, to immediately, without notice to suspend or terminate your ability to use of ANY AND ALL Enhancement Media websites with or without any breach by you of said Terms & Conditions of Use. 

Section 8 - Indemnification 

By continuing to use any and all Enhancement Media websites, subsites,  message boards, discussion rooms, public noteboards, bulletin boards, information archives, chat rooms, etc. you, the visitor, agree to indemnify, defend and hold harmless Enhancement Media and its owners, subsites, subsidiaries, affiliates, members, business partners, employees, researchers, moderators and volunteers from any loss, liability, claim, demand, damage, or expenses including any attorney's feels, court fees, taxes, etc avowed by any third party relating in any way to your use of any Enhancement Media web site, merchandise, referral services, product recommendations or otherwise.

Section 9 - Changes to this Terms of Use 

Enhancement Media holds and retains the right to change or alter, at any time, at its sole discretion, any portion of any section, in part or in full, this Terms & Conditions of Use.  Enhancement Media, its owners, subsites, subsidiaries, affiliates, members, business partners, employees, researchers, moderators and volunteers hold no obligation to report to you any such changed or alterations. You and you alone are responsible for reviewing or inquiring about any changes to the Enhancement Media Website Terms & Conditions of Use.

Section 10 - Failure Of Compliance

If at anytime you feel you are unable to comply with the Enhancement Media Website Terms  & Conditions of Use IN ITS ENTIRETY you must:

Your continued use of ANY AND ALL Enhancement Media Websites will signify your acceptance of any change or alteration in the terms and conditions of use set forth herein or your mental inability to refrain from doing so which Enhancement Media will thereby report said offender to internet providers of said offender, local authorities, and pertinent law officials.

Further, Enhancement Media retains the right to ban or deny viewing privileges to anyone at any time for any reason without prior notice and without explanation.  If Enhancement Media feels that any information which a visitors provides to or displays on any public or private message board, chat room or newsgroup we retain the right to remove said visitor and prevent further posting by that person.  By posting on our public or private message boards, chat rooms or newsgroups you agree to comply with any and all rules outlined in The Agreement.  Failure to do so will result in banishment from any and all websites owned or controlled by Enhancement Media.

Section 11 - External Links 

Enhancement Media websites may contain links to other websites. You agree that Enhancement Media does not endorse any other websites and is not liable for any loss or damages related to the content, products or services available through those sites. If you have any problems or concerns regarding other sites, please contact their respectful site administrator or webmaster directly.

Section 12 - Linking to Enhancement Media websites: 

You may provide hypertext links to our website on another website, provided that: 

(a) the link be a text-only link clearly marked with the name of the website found in the title bar.
(b) the link must 'point' to the URL 'i.e. http://www.boobapalooza.com'  and not to other pages within the Website, unless specific permissions has been given,
(c) the appearance, position and other aspects of the link may not be such as to damage or dilute the goodwill associated with Enhancement Media name, 
(d) the appearance, position and other aspects of the link may not create the false appearance that an entity other than our websites are associated with or sponsored by anyone other than Enhancement Media,

If any provision of this Terms of Use is found invalid, unlawful or unenforceable, such provision shall be interpreted to reflect the parties' intentions as nearly as possible, and shall not affect the validity or enforceability of the remaining provisions. You agree that regardless of any statute or law to the contrary, any claim relating to our site or services, or this Terms of Use, must be commenced within six months after such claim arose or it is forever barred. 

It is the express wish of the parties that the Terms & Conditions of Use and all related documents have been drawn up in English.

All Enhancement Media Message Boards, Discussion Forums, Bulletin Boards, Public Noteboards and Chat rooms, in their entirety, are provided 'as is' for general informational purposes only. They are not intended to provide medical advice, and should not be relied upon as a substitute for consultations with a qualified health professional who is familiar with your individual medical needs. No one else sees your information but admin unless specifically noted at the top of a post (IPs)  This information is only used for administration purposes. Enhancement Media will never sell, trade or otherwise give away anyone's information unless Enhancement Media deems it necessary to remain with lawful bounds by local and national law enforcement agencies or if subpoenaed to divulge such. This includes: IPs (internet provider information unless it is public information), email addresses, names, locations or homepages unless it is already obvious and accessible by the public.
